To me, it doesn't make sense to talk about "free speech instances" when literally anyone can host their own if they're not braindead. Instances aren't democracies, admin get to pick whatever they like if you use their service for free. I don't mean to be antagonistic, I think we're all roughly on the same page.

It's always been: you are allowed to talk about any topic you want, but there are some pictures that are not allowed. It goes further than legality. There are servers that people can go to if they want that kind of thing, it's not like there's no options. But I made a decision that I was not going to allow loli. I personally hate furry but it's allowed.
